Legal Studies in Germany

If you have already completed a law degree in your home country when you first came to Germany, it is usually difficult to find an immediate employment here. This is because, for objective reasons, your education cannot be fully recognised in Germany (in your country you have studied the national law of your country).  This is a problem that many lawyers have to deal with. But you should not get upset, because there are several ways of solving them. The most important thing is to decide what you would like to do. By deciding by elimination (i.e. what you do not really want to do) you can find out which route is best for you. Possibility 1. Working as a lawyer, prosecutor or judge If you have the status of a lawyer in your home country, you can have your qualifications recognized in Germany and be allowed to practice law or give legal advice only under the law of your home country. But if you do not have this, or if you do not want to be limited to the law of your home country, or if you want to work as a prosecutor or a judge in Germany, then you will have to study again. This means that you start at a law school at a German university, which ends with the First State Examination (Erstes Staatsexamen). That is a really difficult thing to do.  For this final exam alone, students usually prepare for one to one and a half years. About a third of candidates fail the exam regularly. There are 2 to 3 attempts and in case of final failure, the study of law (in the classical sense) is closed forever. It's a very harsh system, but it fosters focus, diligence, perseverance and stamina. It also prevents you from neglecting your studies. If you pass the First State Examination you have the title of a qualified lawyer and can thereby complete your law studies. However, you will still not be able to work as a lawyer, prosecutor or judge. In order to practise these professions, you will have to enrol in the so called Referendariat. It is a civil service in the form of a public-law educational relationship and consists of practical modules in various judicial bodies (prosecutor's offices, courts, state and local government authorities) and in the lawyers office. At the end of the Referendariat, you have to take the Second State Examination (Zweites Staatsexamen), which is even more difficult than the First State Examination. It is a big test that not everybody can pass. But if you pass it, you can finally work as a lawyer, prosecutor or judge in Germany.This is only a brief description of a legal education. It is very difficult and risky. Even for Germans themselves, for whom German is a native language. Possibility 2. Working in fields related to law In Germany you can also study for a Master of Law (LL.M.) at a university or for a Bachelor of Law (LL.B) in business law at the High School of Applied Sciences (Fachhochschule). With this education you will be one step closer to the German labour market and can find work in the field of free economy (in companies, banks, sometimes even in municipalities). The most important thing is the knowledge of German language and work experience. German Ambassador to India: Living in a society with respect for their culture

In this interview with New2, the German ambassador in New Delhi talks about what integration means to him, what similarities there are between German and Indian culture, and what blunders he himself has already put his foot in. New2 would like to thank Walter J. Lindner, who has been Ambassador to India since 2019, for this in-depth interview.Anjana Singh: Mr Lindner, thank you very much for taking the time today. I have brought some questions on integration in a new society. How important do you think it is for people who move to another country to integrate into society?Walter J. Lindner: Of course, it depends on how long they are in the country. If they are only there for a short time, then it is not so important. But the longer they are there, the more important it is for them to learn the language and to know what the culture is. It's about showing respect for the country, but also understanding the country and the mentality better.Take for example that I am in India now, I don't sit here in the embassy all the time, I go out. I go to the different states and I go to the markets and so on, because I want to know what makes Indians tick. When I go to Germany as an Indian, it is of course also good to know what makes Germans tick. What is their mentality like, why are they like they are.Then I have to know something about history, politics, sociology, music, all sorts of things and so on. The more they know, the more they feel comfortable. Integration is exactly that. Not that you give up what you bring with you, but that you see what others are doing and how you can bring yourself into it?Anjana Singh: Exactly! That is also what you are doing here. A lot is known about German culture, but also about Indian culture. But from your perspective, where do you see commonalities between German and Indian culture? I think if you can see the similarities at the beginning, then it's easier to find an approach to the culture and the people. Where would you say there is common ground between Germany and India at certain points, or do you see none at all?Walter J. Lindner: Yes, there are! But that is also the reason why I am here, because I want to find out where the similarities are. There must be many, because it's not for nothing that there are the largest number of Sanskrit scholars in Germany - more than in India. That is, there is all this interest in Indian culture in Germany.I think both mentalities are a bit "no-nonsense", so to speak, we are very straightforward, we say what we want, we don't beat around the bush, but are straightforward - a certain seriousness, to put it that way. There is a certain depth in the culture, here it's thousands of years, in Germany it's also long years. So we have an old culture that people are proud of and can always refer to.And then I think it's the case that Germans like to travel. They are among the world champions of travel and they are interested in foreign cultures. Many are drawn to India because they want to decipher this mystical India. What I see is that many Indians know the foreign countries they have travelled to only from a professional perspective, like the UK. The rest of the countries in Europe, for example, they know mainly through Bollywood films, like Switzerland, France and so on. But there is so much more to Europe. And what there is in Germany, we want to highlight a little bit. These are landscapes, culture, mentality, music and so on. There are many things that are perhaps not yet so well known in India, but which arouse great interest.In short, I see a lot of cultural similarities between the two countries. But we also have relations that go far beyond the culture. From students to scientists to business relations, with CEOs and German companies.Anjana Singh: Yes, this kind of exchange has existed since the 1960s.  Walter J. Lindner: Exactly. In the 1960s there was also a special exchange through all the youth in Europe who said we have to look for spirituality. I was there too. Many people came to India to meditate, for yoga, Ayurveda, transcendental meditation and so on.Anjana Singh: Do you see any changes at this point - you were already in India then and now you are here again - from then to now?Walter J. Lindner: Yes, I think in general there was a worldwide search for meaning, for depth and for spirituality in the 70s. In the 80s and 90s it was more about being economically successful. And now there is a certain return to spirituality. It never went away, it was just a bit suppressed. I do believe that after COVID there will be another phase where people will say, now we've pressed the pause button and what do we actually want now? Do we just want to go even faster and even more or do we just want to think about what we want in this life? And India is the perfect place for that.  Anjana Singh: You are now so well integrated, I would say, you have travelled much more in India than I have. Did you have a funny experience somewhere or did you commit any blunders here in India?Walter J. Lindner: I think you always have to have a certain respect for the culture. Whether you go into a temple and ring the bell with your left hand, that's already blundering. Or you give someone a gift with your left hand, that's not allowed either. So these are things you shouldn't do. Respect for religious feelings is especially important. Since there are at least ten major religions here in India, there is also something spiritual at every corner, so I have to be careful. Not watch out in the sense that it's all forbidden, but where you have to show a certain sensitive behaviour. Covering your head, taking off your shoes, not walking out of the temple with your back to the deity. There are a lot of things that you come to know over time. And that is excused in the case of a foreigner, because you say, yes, he doesn't know. But if you are here for a long time and you want to respect the country, then it is important to know these things. So I've committed all these blunders, but I've learnt from them and now I hope I'll be able to avoid those.Anjana Singh: What could an app like the New2App do to cover the social parts in favour of integration? In other words, what content should we have on this app that makes it easier to arrive socially in Germany as well?Walter J. Lindner: Such an app is indeed useful because it bundles information. What can I expect when I come to Germany? But conversely, what can I expect if I am German and come to India? Both are important for integration. Off the top of my head, I can think of topics like: What specialisations are there in the individual universities, but also very general questions about how society functions, how the state is structured, how neighbourhoods help each other, how to behave with the authorities, and so on. It's endless, you can put a lot of things in there that are useful. It doesn't have to be complete at the beginning, it can become more and more condensed in the course of time and then you see that it becomes a real smorgasbord of information.Anjana Singh: Thank you very much for taking so much time to speak to me. Walter J. German Embassy's Tips for Studying in Germany 

Philipp von Ritter from the German Embassy gave us valuable tips on first steps and the preparation for Indian students who want to study in Germany. Philipp is the science counselor at the German Embassy in New Delhi and met Anjana Singh for an extensive interview in November 2021.Anjana Singh: Namaste, Philipp. Thanks for taking the time to talk to us about questions which are relevant for Indian students who want to study in Germany. Philipp von Ritter: Yes sure. It’s my pleasure. We are here at the German Embassy in New Delhi. In every German Embassy we have a science section which works exclusively on issues like research, innovation and higher education. And also issues like student mobility for students who are coming from India to Germany and vice versa. First steps for students who want to study in GermanyAnjana Singh: What would be the first step for Indian students who want to study in Germany? There is a lot of information out there, but you never know how reliable it is. So what would you, as an expert in that field, recommend for gathering information about studying in Germany? Philipp von Ritter: So first of all I think it is really remarkable if young Indian men and women decide that studying in Germany would be an option for them. We don’t take that for granted at all. It’s a big step, a big step to go abroad for studying, a big step in terms of finances, a big step in terms of all the administrative hurdles and also a big step in terms of the pure mindset. Going to another country, and going to Germany especially where people don’t speak English as their native language, can be challenging. So this is really something remarkable and we are very very happy at the German Embassy in Delhi that so many young Indians take that decision. The two phases of gathering information and of deciding to eventually study in Germany are interwoven. We are very lucky that in Germany we have the German academic exchange service DAAD. The DAAD is providing information worldwide on student mobility and on possibilities to get into German universities for foreign students. They do not only provide information through their website, but also through their data basis, as well as in info sessions. These info sessions have become virtual due to the Corona pandemic which makes it even more accessible for interested students all across India. I would highly recommend going to the DAAD website for any student who says I am interested in Germany as a place to study. The DAAD will provide you with the best, the most relevant and the most comprehensive list of opportunities that exist in Germany. An advantage of DAAD over other websites is that they are not guided by some particular interest from some German university or some agents who want to make profit. But it will be guided by the common ambition of the German university system to internationalise itself and to enroll the cleverest students from across the world - and we know that there are many in India and we are happy that many of them want to come to Germany.Anjana Singh: Precisely because so much unreliable information is in circulation, the Federal Ministry of Economics and Technology has funded the development of our New2App. Have you already taken a look at the app? Do you think it could be an additional tool for Indian students who plan to go to Germany or are already there? Philipp von Ritter: I have downloaded the app. And I find it very good. There are many possibilities to gather this information, and many innovative ways to get this information which is relevant for study plans in Germany. And amongst others I think the New2App is one of them. Every initiative like the New2App is really appreciated which explains why our Ministry of Commerce is funding it. What I think is great about initiatives like that is that you have very helpful overviews in the form of interactive and easy-to-access information. There may also be informal networks of students sharing their experiences. And I think the first hand exchange is so important. Because it really increases the impact. For DAAD we have the so-called young ambassadors. They are very successful Indian students who are coming back from Germany. They are in different stages of their careers and in different disciplines but what they all share is that they are very passionate about the experiences that they made in Germany. So when they come back and spread across India, they are really ambassadors for studying in Germany. The list of them can be found on the DAAD website. Preparations for studying in Germany Anjana Singh: One question we always get is how far in advance should you try to get a visa for Germany as a student. Can you say something about this, Philipp?Philipp von Ritter: That’s a very good question. I think it leads to a broader question, that is  when should you start preparing for your university studies and your move to Germany? And that takes a lot of time. The admission deadlines for the universities are often way before the start of the actual university semester. In general, I would say, once the admission letter is there, even if it is a conditional admission letter, that’s the moment when you should - if you haven’t done it so far - consult the webpages of the German Embassy in Delhi on the visa requirements and the visa processes. Additionally, check the website of our service provider vfs, where you will be handing in your visa application. On these websites you have different lists and recommendations about the time frame of your application. Generally, they provide guidance from the moment that you realise you need a visa until the moment you will get your visa. That process will take some time. Firstly, it will take some time before you get your visa appointment itself, especially right now with this situation in which lots and lots of students wanted to go to Germany but could not go in the past two years due to the pandemic. There is a huge demand and the visa appointments are just not enough, so the delays are already there. Even once you hand in your visa application, it will take some weeks to process it at the embassy and to get the necessary approvals from the agencies in Germany. So there is no one-size-fits-all answer but you find all the information on the webpage of the German Embassy and on the webpage of the vfs service provider. Anjana Singh: Sometimes questions arise which are not listed anywhere. Is it possible to contact the German Embassy directly via email? Philipp von Ritter: Definitely. The German public administration is an administration which is at the service of the citizens and also at the service of foreign citizens. So on every German agency’s website there will be a contact form where you can put down your request and the request will then be processed by the respective agency. That’s also true for the German Embassy in Delhi. That being said, you said there are questions where you can’t find the answer anywhere. But most of the questions are being answered either on the website of the Embassy or on the website of DAAD (www.daad.in). So in many cases my reply to these requests would be: please refer to the DAAD website. Often it’s worthwhile to check all these different options before writing to the German Embassy but of course everybody should feel free to approach the German Embassy with their request which will be answered in due course. Anjana Singh: A lot of students have questions regarding scholarships and the process of visa applications in case they hold a scholarship. Philipp von Ritter: Scholarships are a very important topic. Firstly I have to say, we are very proud that there are many scholarships for Indian students who are going to study in Germany. And all of these scholarship programmes have their own scholarship rule books and their own counselors who assist all the scholarship holders. Because these are VIPs. Every scholarship holder for us is a VIP. They get a VIP treatment in terms of visa. The visa process is very quick. But of course they also get the VIP treatment from the scholarship giver. So for any inquiries regarding the scholarships you should always approach the scholarship offices for the relevant information. The German School System

Are you new to Germany and looking for a good school for your children? In many countries, this is a difficult task. Not so in Germany, where the public school around the corner or a few streets away is the first choice for most parents. There, your child will meet many children from the neighborhood, receive a high-level education, and do so without paying any school fees.How does the German school system work?The responsibility for the school and university system in Germany lies with the federal states. These have the so-called cultural sovereignty and can decide relatively independently how to design their school system. As a result, there are major differences between the individual federal states. However, the association of the Ministers of education of the individual states in the Kultusministerkonferenz (Conference of Ministers of Education and Cultural Affairs) ensures that there are common educational standards across the states.Compulsory schoolingIn Germany, school attendance is generally compulsory. This means that unlike in countries where there is only compulsory education, parents are not allowed to teach their children themselves, but must send them to school. This applies not only to German citizens, but also to foreign children living in Germany.School hoursIn many schools, classes end at noon or in the early afternoon and students come home for lunch. For children who need afternoon care, there is the option of attending an after-school care center, called ‘Hort’. There, they can have lunch, get help with homework, or spend their free time playing sports or doing something creative. But the number of all-day schools, where classes extend into the late afternoon and students are cared for throughout, continues to grow.School vacationsSchool vacations are also not uniformly regulated in Germany, but vary from state to state. This regulation is intended to prevent all families from setting off on vacation at the same time and causing major traffic jams on the roads. In total, there are about 12 weeks of school vacations, including 6 weeks in summer, 2 to 3 weeks at Christmas and Easter, and additional vacation periods in spring and fall.Grades and report cardsStudents' performance is assessed during the school year in written and oral tests and grades are given from 1 to 6, with a 1 being the best grade and a 6 being the worst. At the end of the school year, each student receives a report card. During the school year, however, there are several parent-teacher conferences in which the teachers inform you about your child's academic performance.Which schools are there?First you go to the elementary school, called Grundschule. Here children are enrolled between the ages of 5 and 7. At the elementary school you stay 4 years, in Berlin and Brandenburg 6 years. The choice of elementary school is usually not free. Children must attend the elementary school in their school district. This makes a lot of sense, because it allows them to get to know children from the neighborhood, to make the trip to school together, and to arrange to play and learn together after school.At the end of elementary school, teachers make recommendations for students' future school careers based on their performance. Now the parents look for a secondary school together with their child. There are several options.The 3 traditional types of schools are as follows.The Hauptschule is designed to provide a basic general education. Students finish it after 9th grade with the`Hauptschulabschluss' or after 10th grade with a qualified ‚Hauptschulabschluss‘. This is the lowest school-leaving qualification in Germany.The Realschule offers an extended general education. It ends after the 10th grade with the ‚Mittlere Reife‘.Now compulsory schooling ends and young people can either start an apprenticeship or attend a vocational school. But don't worry. If your child wants to continue learning after the Hauptschule or Realschule and take the ‚Abitur‘ so that he or she can later go to university, there are various ways in the individual federal states for ambitious Hauptschule and Realschule students to take the Abitur after all.The Gymnasium has a very comprehensive educational mission. To be able to attend a Gymnasium, you need a good grade point average at the end of elementary school. The general university entrance qualification, called Abitur, is obtained after the 12th or 13th grade. With the Abitur in your pocket, you can then go to study at a university.An innovative school model is the comprehensive school, also called Gesamtschule. Here, no distinction is made between Hauptschule, Realschule and Gymnasium, but all students learn together in one school until the 10th grade. After that, students can choose between vocational training or the Gymnasiale Oberstufe (upper secondary school).A similarly integrative approach is taken by the secondary school, the Sekundarschule, in several German states.  This usually covers the school years 5 to 10 and combines the Hauptschule and Realschule. The aim of the secondary school is to prepare students either for vocational training or for the Gymnasium. In some federal states, such as Berlin, the secondary school also offers an upper secondary school branch and the possibility of taking the Abitur there.Open dayAlmost all schools offer an open day in the spring so that parents and students can get information and choose the school that appeals to them most. Also, the summer festivals traditionally held in schools just before the end of the school year provide an excellent opportunity to see the school from the inside. SchulamtThis is an overview of the German school system. However, since there are really many differences from state to state, it is important to inform yourself well about the situation in the city or state where you live. The responsible authority for this is the school board, the Schulamt, and if you enter this with the corresponding city in Google, you get a good overview of the school situation locally.Private IB schoolsOf course, there are also private schools in Germany. And in larger cities you can also find International or European schools, which are either graduated with the IB, the Abitur or a double degree. It is important to be well informed about the implications of choosing such a school for access to a German university. While anyone who applies with a German Abitur, even if they do not have a German passport, is considered a ‚Bildungsinländer‘, IB students must observe special requirements for admission to universities and must also accept a minimal point deduction when aligning with the German Abitur. Universities in Germany - How to find the one that fits you

Germany has a diverse university landscape with more than 400 institutions of higher education, which mostly include Universitäten (universities) and Fachhochschulen (universities of applied sciences). The majority of these universities in Germany are operated and funded by the state which means they do not charge any tuition fees apart from a comparatively small contribution for administrative purposes (Semesterbeitrag). This rule also applies to foreign students who study in Germany - with the exception of the state of Baden-Württemberg where international students who are not citizens of an EU-country have to pay a fee of 1.500€ per semester. By contrast, the study fees at private universities in Germany can easily amount to more than 500€ a month. Bearing in mind this important difference, helps to understand why a lot of German students prefer state universities over private ones. In contrast to India, private colleges in Germany are often not outperforming their state-run counterparts in terms of quality of education or research. To the contrary, the most renowned German institutions ranking among the world’s top universities are state-sponsored. However, private colleges have certain advantages on their side such as smaller batches of students which can facilitate a more productive learning environment.In view of such a large number of universities which offer a broad range of study programs, making your own decision on where to apply can be challenging. The following search engines can help you to get a first overview of the German university landscape:Higher Education CompassZeit.de – Search Engine for Study ProgramsDAAD (German Academic Exchange Service) - Search Engine for International Programs and ScholarshipsApart from searching for specific subject areas or university locations, these websites also make it possible to filter your search according to other criteria such as degree level (e.g. Bachelor or Master), study mode (e.g. part/full time or on-site/distance) or admission restrictions. With regards to the latter, German universities have a system of local and nationwide admission restrictions which are aimed at selecting students for the most popular study programs. While several factors come into play, the most important one is the final grade of the university entrance qualification. For foreign students, this system means that only a limited number of places at the universities are reserved for them. Study programs without admission restriction, however, are open to all applicants as long as they fulfil the admission criteria such as a recognised university entrance qualification and sufficient language skills. The website uni-assist can be a useful tool to make sure that your application meets all the criteria. Depending on the university and the respective study program, international students are often asked to hand in their applications directly through uni-assist.  Nevertheless, you should always make sure to check the respective website of the university you’re interested in. There you can find detailed descriptions of the programs, the requirements and additional information you might not get in the search engines or on uni-assist. Additionally, you can gather information on Facebook. Since a lot of universities in Germany have groups for their students, you can get in touch with people who already study in Germany at the university of interest. They might be willing to answer questions regarding the life at campus and the reality of studying there which you will not get on any of the official websites. We hope this article gives you a helpful overview on how to decide for a university in Germany.
